has been concluded electronically between the parties within the framework of the terms and conditions set forth below.
2. SUBJECT OF THE AGREEMENT
This Agreement
concerns the determination of the rights and obligations of the parties, in accordance with the provisions of Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts, regarding the sale and delivery of handmade products, olives, olive oil, medicinal aromatic oils and similar food and agricultural products ordered electronically by the Buyer through the Seller’s website.
3. INFORMATION ON THE PRODUCT / SERVICE SUBJECT TO THE AGREEMENT
The following information regarding the product or products subject to the Agreement;
• Type,
• Name,
• Essential characteristics,
• Sales price (including taxes),
• Shipping fee (if any),
• Payment and delivery information
has been presented to the Buyer within the scope of the Preliminary Information Form and order summary at the moment the order was completed and constitutes an integral part of this Agreement.
4. DELIVERY OF PRODUCTS
4.1. 4.1. The products shall be delivered to the address and to the person/entity specified by the Buyer during the order process.
4.2. 4.2. The delivery period shall be scheduled to take place within the statutory period of no later than 30 (thirty) days. In case of force majeure or production-related delays, the Buyer shall be informed.
4.3. 4.3. In handmade products, due to the nature of the products, there may be variations in color, texture and minor dimensional differences, which are accepted by the Buyer.
5. PAYMENT
5.1. 5.1. The product price shall be paid by the Buyer through one of the payment methods provided on the website.
5.2. 5.2. Shipment shall not be made before the payment is completed.
5.3. 5.3. The Seller shall not be liable for technical malfunctions that may occur during the payment process.
6. RIGHT OF WITHDRAWAL
6.1. 6.1. General Rule
The Buyer has the right to withdraw within 14 (fourteen) days without giving any reason and without paying any penalty.
6.2. 6.2. Situations Where the Right of Withdrawal Cannot Be Exercised
Pursuant to Article 15 of the Regulation on Distance Contracts, the right of withdrawal shall not apply to;
• Food products,
• Olives, olive oil and similar perishable products,
• Products whose packaging has been opened and which are not suitable for return due to hygiene reasons,
• Handmade products produced specifically
for the individual.
These products are excluded from the scope of the right of withdrawal due to reasons of personal production, health and hygiene.
7. RETURN AND CANCELLATION CONDITIONS
7.1. 7.1. For products where the right of withdrawal can be exercised, return shall be accepted provided that the product is unused, undamaged and in its original packaging.
7.2. 7.2. Returns shall not be accepted for products outside the scope of the right of withdrawal.
7.3. 7.3. The return shipping cost shall be determined in accordance with the legislation regarding the exercise of the right of withdrawal.
8. OBLIGATIONS OF THE SELLER
8.1. 8.1. The Seller is obliged to deliver the products in accordance with the qualifications specified in the order.
8.2. 8.2. The Seller expressly declares that the products are not of commercial industrial production but fall within the scope of traditional and handmade production.
8.3. 8.3. The Seller accepts that the products are not medicinal or therapeutic products and makes no undertaking in this regard.
9. OBLIGATIONS OF THE BUYER
9.1. 9.1. The Buyer is responsible for the accuracy of the order information.
9.2. 9.2. The Buyer is obliged to inspect the product at the time of delivery.
9.3. 9.3. In the event that the delivered product is damaged during shipment, a report must be drawn up by the courier officer.
10. PROTECTION OF PERSONAL DATA
The Buyer’s personal data shall be processed within the scope of the Privacy Policy and Clarification Text on the Protection of Personal Data.
This text constitutes an integral part of this Agreement.
11. FORCE MAJEURE
Natural disasters, epidemics, strikes, war, transportation obstacles and circumstances that develop beyond the control of the parties shall be considered force majeure.
12. RESOLUTION OF DISPUTES
In disputes arising from this Agreement;
• Within the monetary limits announced annually by the Ministry of Trade,
Consumer Arbitration Committees,
• In cases exceeding these limits, the relevant Consumer Courts and Enforcement Offices
shall have jurisdiction.
13. EFFECTIVENESS
This Agreement shall enter into force on the date it is read and approved electronically by the Buyer. By completing the order, the Buyer declares that they have read, understood and accepted all provisions of this Agreement.
