has been concluded electronically between the parties within the framework of the terms and conditions set forth below.<\/p>\n\n
2. SUBJECT OF THE AGREEMENT<\/p>\n\n
This Agreement<\/p>\n\n
concerns the determination of the rights and obligations of the parties, in accordance with the provisions of Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts, regarding the sale and delivery of handmade products, olives, olive oil, medicinal aromatic oils and similar food and agricultural products ordered electronically by the Buyer through the Seller\u2019s website.<\/p>\n\n
3. INFORMATION ON THE PRODUCT \/ SERVICE SUBJECT TO THE AGREEMENT<\/p>\n\n
The following information regarding the product or products subject to the Agreement;<\/p>\n\n
\u2022 Type,<\/p>\n\n
\u2022 Name,<\/p>\n\n
\u2022 Essential characteristics,<\/p>\n\n
\u2022 Sales price (including taxes),<\/p>\n\n
\u2022 Shipping fee (if any),<\/p>\n\n
\u2022 Payment and delivery information<\/p>\n\n
has been presented to the Buyer within the scope of the Preliminary Information Form and order summary at the moment the order was completed and constitutes an integral part of this Agreement.<\/p>\n\n
4. DELIVERY OF PRODUCTS<\/p>\n\n
4.1. 4.1. The products shall be delivered to the address and to the person\/entity specified by the Buyer during the order process.<\/p>\n\n
4.2. 4.2. The delivery period shall be scheduled to take place within the statutory period of no later than 30 (thirty) days. In case of force majeure or production-related delays, the Buyer shall be informed. <\/p>\n\n
4.3. 4.3. In handmade products, due to the nature of the products, there may be variations in color, texture and minor dimensional differences, which are accepted by the Buyer.<\/p>\n\n
5. PAYMENT<\/p>\n\n
5.1. 5.1. The product price shall be paid by the Buyer through one of the payment methods provided on the website.<\/p>\n\n
5.2. 5.2. Shipment shall not be made before the payment is completed.<\/p>\n\n
5.3. 5.3. The Seller shall not be liable for technical malfunctions that may occur during the payment process.<\/p>\n\n
6. RIGHT OF WITHDRAWAL<\/p>\n\n
6.1. 6.1. General Rule<\/p>\n\n
The Buyer has the right to withdraw within 14 (fourteen) days without giving any reason and without paying any penalty.<\/p>\n\n
6.2. 6.2. Situations Where the Right of Withdrawal Cannot Be Exercised<\/p>\n\n
Pursuant to Article 15 of the Regulation on Distance Contracts, the right of withdrawal shall not apply to;<\/p>\n\n
\u2022 Food products,<\/p>\n\n
\u2022 Olives, olive oil and similar perishable products,<\/p>\n\n
\u2022 Products whose packaging has been opened and which are not suitable for return due to hygiene reasons,<\/p>\n\n
\u2022 Handmade products produced specifically<\/p>\n\n
for the individual.<\/p>\n\n
These products are excluded from the scope of the right of withdrawal due to reasons of personal production, health and hygiene.<\/p>\n\n
7. RETURN AND CANCELLATION CONDITIONS<\/p>\n\n
7.1. 7.1. For products where the right of withdrawal can be exercised, return shall be accepted provided that the product is unused, undamaged and in its original packaging.<\/p>\n\n
7.2. 7.2. Returns shall not be accepted for products outside the scope of the right of withdrawal.<\/p>\n\n
7.3. 7.3. The return shipping cost shall be determined in accordance with the legislation regarding the exercise of the right of withdrawal.<\/p>\n\n
8. OBLIGATIONS OF THE SELLER<\/p>\n\n
8.1. 8.1. The Seller is obliged to deliver the products in accordance with the qualifications specified in the order.<\/p>\n\n
8.2. 8.2. The Seller expressly declares that the products are not of commercial industrial production but fall within the scope of traditional and handmade production.<\/p>\n\n
8.3. 8.3. The Seller accepts that the products are not medicinal or therapeutic products and makes no undertaking in this regard.<\/p>\n\n
9. OBLIGATIONS OF THE BUYER<\/p>\n\n
9.1. 9.1. The Buyer is responsible for the accuracy of the order information.<\/p>\n\n
9.2. 9.2. The Buyer is obliged to inspect the product at the time of delivery.<\/p>\n\n
9.3. 9.3. In the event that the delivered product is damaged during shipment, a report must be drawn up by the courier officer.<\/p>\n\n
10. PROTECTION OF PERSONAL DATA<\/p>\n\n
The Buyer\u2019s personal data shall be processed within the scope of the Privacy Policy and Clarification Text on the Protection of Personal Data.<\/p>\n\n
This text constitutes an integral part of this Agreement.<\/p>\n\n
11. FORCE MAJEURE<\/p>\n\n
Natural disasters, epidemics, strikes, war, transportation obstacles and circumstances that develop beyond the control of the parties shall be considered force majeure.<\/p>\n\n
12. RESOLUTION OF DISPUTES<\/p>\n\n
In disputes arising from this Agreement;<\/p>\n\n
\u2022 Within the monetary limits announced annually by the Ministry of Trade,<\/p>\n\n
Consumer Arbitration Committees,<\/p>\n\n
\u2022 In cases exceeding these limits, the relevant Consumer Courts and Enforcement Offices<\/p>\n\n
shall have jurisdiction.<\/p>\n\n
13. EFFECTIVENESS<\/p>\n\n
